I believe that anyone may encounter experience in going to the court or tribunal at some point of his/her life, which leads to the observation of existence of self-represented litigants for their own cases. Some litigants think that they can handle their cases, since they are comfortable and confident in representing themselves with a cost-saving budget. Well, nothing is wrong with it, but it may not be the most beneficial approach to win a case from the perspective of a legal professional.
Keep in mind of the following that may have its shortcomings if you decide to be self-represented:
- You are unfamiliar with the rules and procedures of the court or tribunal;
- You may present a lot of information that is irrelevant to the case, which will never get you to the main issue(s) of your case;
- You may not know how to organize material or/and evidence in a way which is in favor of expressing your arguments effectively;
- You may express opinions out of your emotion or frustration during your attendance for the case at court, notwithstanding that the fact is key to win the case;
- You may have no knowledge in terms of how to ask effective questions sometimes to the opposite side of your dispute to prove your point(s) or argument(s) in the case;
- You may not acknowledge that sometimes there is no one rule fits all, while other factors, your unique situation and risks should be weighted to execute the most appropriate strategy of your case;
- You may suffer from distress without having a legal professional to be relied upon in the area where technical expertise is highly demanded;
Being a self-represented litigant may not get you the desirable outcome that you want, not to mention the possibility of losing your case, or a request from the opposite party to submit a motion to strike your case.
Retaining a legal representative is not just effective when fighting for your case at court, but it is also wise to seek for a legal advice when anticipating any possible dispute arising. The role of a legal representative is to negotiate with the party which you may have a dispute, or to instruct you what to collect as evidence in advance to be effective in your civil litigation. Nowadays, the Paralegal profession provides a good option for any individual to retain a legal representative in a more affordable way.
